Just as in any given society where we have the right to choose to do and be whatever we want, we all have the God given right to choose to do and be whatever we want with the life that He gave us. What we must understand thought is that with each choice we make, there are consequences that will be either negative or positive and we will have to live with the consequences of the choices that we make.
In society, if we choose to live outside of the boundaries set by the law, then we must be willing to suffer the consequences of the choice that we make. In some cases, the consequence is imprisonment. For some, that imprisonment could be for the remainder of their natural life. Appeals to the higher courts can sometimes have decisions reversed - but there is no guarantee.
Spiritually, if we choose to live outside the boundaries set by God then we must be willing to suffer the consequences of the choice we make. The end result of this choice is an eternity outside of the presence of God. In other words, we will not be a part of the new heaven and the new earth. The court of God is the highest court and therefore there is no court of appeals to which one can further plead their case.
As human beings, we have categorized behaviours and have determined which actions are punishable by death and should bar one from God's presence forever but let's read what God's word says about who will not be a part of the new heaven and the new earth.

But those who are cowards, those who refuse to believe, those who do terrible things, those who kill, those who sin sexually, those who do evil magic, those who worship idols, and those who tell lies—they will all have a place in the lake of burning sulfur. This is the second death.”
